Confederation and Constitution Essay The Articles of Confederation, formally known as the Articles of Confederation and Perpetual Union, refers to an agreement between the thirteen founding states that first formed the United States of America as a confederation of sovereign states. The Articles of Confederation had served as the first U.S. constitution (Merrill, 1959). The states under the confederation were Virginia, South Carolina, New York, Massachusetts, Connecticut, Georgia, Rhode Island, New Hampshire, New Jersey, Pennsylvania, North Carolina, Delaware and Maryland. In 1787, a constitutional convention was called to revise the Articles of Confederation as they contained so many flaws, which would have fatally affected the confederation (Wendel, 1981). However, the convention ended up abandoning the Articles and drafted a new constitution which had a much stronger national government. After so much tussle and debating, eleven of the thirteen states ratified the constitution which led to the formation of a new form of government for the United States of America (Kermit, 1987). The following are similarities and differences of the Articles of Confederation and the Constitution. Consenting of power According to the Articles of Confederation, the legislature of each state had no specific means of choosing voters. The delegates of each state were to sign the Articles, but only do as directed by their legislature (Young, 1977). Their legislature did not provide for them to vote in such agreements thus, they only wait until instructed so. This shows that the Articles of Confederation did not provide how it could be ratified, but indirectly implied it the duty of the legislatures of the various states. This meant that the people had no direct influence over the form of national government being put in place because their representatives were not specifically elected for that purpose.The Constitution provided for conventions in the states whereby delegates are chosen by people for the purpose of considering ratification. Therefore, the Constitution had specifically addressed its ratification in Article VII (Maier, 2010). The provision that ratification by nine states were to effect it meant by passing the state legislature and going to the people for governing consent. In summary, in the Articles of Confederation, consent of power was from the state while in the constitution the power to govern came from the people to the government. Type of National Government Under the Articles of Confederation, the government was more of a constitutional confederacy, whereas the Constitution provided constitutional federal republic (Merrill, 1959). Under both, the government was a constitutional government because it was codified in writing. The government structure between the two, however, differed. An association of States under a common government formed the confederacy. Each member state retained its sovereignty leaving the national government with very little authority over the individual state (Young, 1977). The National government powers tilted towards foreign relations for the benefit of all the states. This meant that the National Government could not coerce individual states to do anything. The constitution provided for a federalism structure (Kermit, 1987). This ensured a more equated power sharing between the National government and the state government. The National government, therefore, had sufficient sovereignty to execute its mandate while ensuring the same for the state government. Representation in the National Government In the Articles of Confederation, indirect popular representation was in effect as the representatives were appointed by an elected state legislature (Wendel, 1981). On the other hand, the Constitution effected direct popular representation for both the states and the citizens. The people, through popular vote, formed the House of Representatives while the states ,through elected legislature, appointed the Senate (Kermit, 1987). The representation according to the constitution was in accordance with the structure of Federalism. Division of Powers in the National Government Articles of Confederation provided one legislative body (unicameral) with all powers of national government which was the Congress Assembly. All decisions and relations were derived from the Congress (Wendel, 1981). Matters of law, settling disputes, foreign relations, including all the others issued from Congress (Merrill, 1959). However, Congress did not have the ability to implement laws, and had limited ability to judge on law or disputes because a dedicated judiciary was not in place. The Congress, however, appointed courts to preside on piracy and High Seas crimes, resolve disputes between States and individuals from different States. The Constitution, however, provided for division of power of the National government into three distinct branches, each with specified duties. The Legislature composed of the Senate and House of Representatives is mandated with making laws (Maier, 2010). The executive was to enforce laws with the President while the Judiciary and inferior courts is to judge using the law. A mechanism was also provided to each of the three branches to view the power on other two and encroachments into other branches powers. Powers of Congress The Articles of Confederation provided specifically enumerated powers to the congress which included regulating foreign commerce. Congress could not, however, regulate interstate commerce (Wendel, 1981). Some of the powers remained the same although others differed. Among the powers included in the Constitution but absent in the Articles of Confederation are taxing, regulating interstate and foreign commerce, making of uniform laws on bankruptcy, raising and supporting an Army and Navy and establishment of inferior courts (Kermit, 1987). Congress Assembly lacked all these powers under the Articles of confederation. Revenue Raising The Articles of Confederation provided that National Government should request for funds from the individual states (Wendel, 1981). The Constitution, however, gave the National Government power to tax. A major shortcoming of the Articles of Confederation was a failure of providing for the National Government to raise its own revenues (Young, 1977). Congress assembly requested funds from states for National treasury. This resulted in the states failing to comply as requested. This made the United States lag on paying its debts and meeting its obligations. Under the Constitution, Congress could raise revenue for costs and operations of the National Government, namely, common defense and general welfare of the United States (Maier, 2010). However, some restrictions were imposed regarding revenue raising of the National Government. The provision of raising revenue for National government ensured it did not rely on other entities namely, the states to execute its duties. Enforcement of Federal Laws The Articles of Confederation did not provide for the National government to enforce its laws thus it had to rely on States for this function (Wendel, 1981). Laws, treaties, acts or agreements passed by Congress Assembly were up to states solely to enforce (Merrill, 1959). This resulted in them only enforcing what favored and suited to them. The Constitution on its part, gave the executive branch through the President power to enforce laws (Maier, 2010). This provision enabled speedy execution of laws and execution of the government requirements. The Anti-Federalists such as James Hancock feared that the National Government, the Executive branch and Congress held too much power. They also argued that the national government could maintain the army during times of peace (Maier, 2010). Contrary to the Anti-Federalists, the Federalists led by James Madison argued that power separation into three independent branches protected peopleââ¬â¢s rights as each of the branches represented a different aspect of the people (Hamilton, Madison Jay, 1982). Because of the equality of the branches, none of the groups could control another. They also argued that listing the rights exposed the people as it would likely result in the government violating those not listed. The Confederate Flag On January 1992 the NAACP put in affect a boycott on South Carolina to pressure the state to remove the Confederate flag off of its Statehouse in Columbia. The boycott is what initially brought life to this issue. The NAACPââ¬â¢s removal request is based on the fact that they, the anti-flag groups, claim that the meaning of the Confederate flag is one of hate and discrimination. On the other hand, there are other groups that believe differently whom are called the pro-flag groups. They claim that the Confederate flag is a sign of heritage and should stay on South Carolinaââ¬â¢s Statehouse. Anti-flag articles are more likely to be found published in well-known Liberal magazines, when credible pro-flag articles were hard to find. The main issue of the debate, which is a definition argument, includes one that argues the meaning of the Confederate flag and what it stands for, and from it many arguments stem that make up the intense debate about the Confederate flag. The Civil War being about slavery is one of the first things addressed in both types of articles. Within this argument, the pro-flag groups claim that many blacks fought for the Confederacy. Then the Confederate flagââ¬â¢s connection with racism is then argued. An anti-flag argument to prove that the Confederate flag is connected to slavery is that it was raised in response to the civil rights movement that was going on in 1961. Another anti-flag argument is that the Confederate flag does not represent the State as a whole and for that reason should not be flown on South Carolinaââ¬â¢s Statehouse. This Amendment guarantees each person of free speech. Does this mean that a person can stand in the middle of the street and yell anything he wants? Does this ensure a more controlled society? Let us imagine a society that has no restrictions of speech. For example, anyone can publish a false story of another person, just for revenge perhaps, and the offended person would not be able to defend himself because there is no restriction of speech. A neighbor in a residential area decides to use a loud microphone to announce his beliefs in the middle of the night, and wakes everybody up. Because that person has every right to speak, nobody can do anything. Even though this is "freedom of speech" it is not allowed in a civilized society. Jack Welch and the GE Way à à à à à When Jack Welch was named CEO of General Electric, Welch saw a company in trouble even though the business world saw GE as an intrinsically healthy corporation, secure in its position as a world industrial leader. Welch knew that the company was too large to fail yet GE was too unwieldy to adapt for further growth. The changes he instituted restructured and revolutionized GE and made Welch the most respected CEO in business today. After reading the book there were three parts that really stood out for me. à à à à à Chapter 3: Cultivate managers who share your vision was the most important chapter to me. It talks about putting the right managers in the right positions. Welch says, ââ¬Å"What we are looking forâ⬠¦are leadersâ⬠¦ who can energize, excite, and control rather than enervate, depress, and controlâ⬠(p. 35). Managers in a company should bursting with energy and are able to develop and implement a vision and not just talk about those visions. They must also know how to spread enthusiasm throughout the entire company. One of the keys to being a great business leader is getting employees excited about their work. One of the ways to get employees excited about their work is to allow employees more freedom and responsibility then they have now. In order to make this happen, middle managers have to be team members and coaches. They need to facilitate more than control. Managers should be energizers and not enervators. Welch suggests that the only way to last at GE is to get on board, to become a team player, and to adapt oneself to the companyââ¬â¢s values and culture when describing the different types of managers that will or will not succeed. The first type of manager delivers on commitments and shares the companyââ¬â¢s values. The second type does not meet commitments and does not share the companyââ¬â¢s values. The third type misses commitments but does share the companyââ¬â¢s values. Welch himself cares more that a manager sticks to the companyââ¬â¢s values than meets the numbers. The fourth type delivers on the commitments but does not subscribe to the companyââ¬â¢s values. Welch broke these managers into three categories, type A, type B, and type C managers. Type A managers were defined as team players that subscribe to the companyââ¬â¢s values. People trust them; they make impacts on decisions, and are leaders who seek to develop high value in other... ...h targetsâ⬠(p. 170). Welch emphasizes that one should not settle for second best when you are able to achieve more. When you reach for the stars, you may fail but stretching yourself and stretching your business you are going to bring better performance results to your business. He also says to be creative, more imaginative, and more thoughtful about your business. The more you think about how to get more out of your business, the higher your stretch targets and the better off your are going to be. I think that all employers and manager should encourage their employees to reach for the stars. This will help employees realize what they are capable of doing. Managers need to help employees realize and make goals along with making sure that they meet their goals. I believe that Jack Welch and the GE Way is a great tool for any manager. He Welch helped turn a great company into an even greater company. Many of his ideas can be used in the workplace and in everyday life. His ideas are not complex or complicated to understand. The article ‘Rebirth of a Profession’ discusses the new Codes of Practice for social care workers and their employers
The article ââ¬ËRebirth of a Profession' discusses the new Codes of Practice for social care workers and their employers, together with the accompanying register, which were published in September 2002 by the General Social Care Council (GSCC). It puts forward the view that this is the culmination of a twenty-year-old dream and the fulfilment of social worker's hopes. Within this assignment the author's reasons for this view and the quality of the argument will be analysed and evaluated using the processes of critical thinking. In order to do this thoroughly Damer's (1995, cited by Gibbs & Gambrill, 1999, p206) four criteria of a good argument will be heeded. If any of these are violated, he states, then the argument is flawed. The criteria require that the reasons must be relevant, acceptable and constitute sufficient grounds for the truth of the conclusion. Finally the reasons should provide effective rebuttal to all reasonable challenges to the argument. Before this can be achieved, consideration of what critical thinking is and its' relevance to social work needs to be undertaken. Critical thinking involves the critical appraisal of beliefs, arguments and claims in order to arrive at well-reasoned judgements. â⬠(Gibbs and Gambrill, 1996, p. 3). Whilst this definition is not absolute it provides a sound basis from which to commence and points to it's application to social care. Social care staff frequently need to evaluate information to solve problems effectively and come to well-developed decisions. Swartz & Parks (1994, p. 338) argue that assessing the reasonableness of ideas is crucial and failing to do so runs the risk of acting on ideas that are incorrect and may lead to harm. The article tries to convince the reader that the codes are a ââ¬Ëdream come true' because they will give social care staff increased status, raise standards of care and increase shared responsibility between workers and employers. The actual codes are not given, perhaps based on the assumption that readers of Community Care, a specialist magazine for social care staff, are already familiar with them. The reasons, given above, fulfil the relevance criteria in that if accepted they contribute to the truth of the conclusion. Whether they are acceptable will be examined later. The fifth paragraph offers an analogy with the Nurse's Code, though the work of nurses is not strictly analogous to that of social care staff. Relevant similarities exist ââ¬â they both deal with vulnerable people, are working to achieve the best possible outcome for the service user and in both cases a mistake could result in serious consequences. The differences, however, question the value of the analogy as evidence (Brink-Budgen, 2000, p. 53). Nursing is a more structured profession and focuses on the ââ¬Ëmedical model' whereas social work deals with a number of different perspectives and models and thus is harder to define. Furthermore, as is stated in the article, the new social work code applies to a range of social care jobs. Therefore it is dubious as to whether the nurses code is relevant or comparable. Fallacies and assumptions, apparent in the reasoning, detract from the acceptability of the argument. Emotional language is used to divert the reader's attention from the real issues. This is illustrated in the first two sentences of the article; the first sentence evokes feelings of pathos followed by the second, which raises the reader to a sense of elation and optimism on behalf of social care staff. In order for the claim that the code will increase successful recruitment to be true, it is necessary to assume that difficulties in recruiting social care staff are due to a previous lack of standards. However there is no consideration given to alternatives such as salary, nor is there evidence to support this assumption. Brookfield (1987, p. ) states that identifying and challenging assumptions is central to critical thinking and develops our contextual awareness. Omissions in the article contribute to a permeating sense of vagueness and lack of clarity. Little evidence/research is presented for the claims made that could be considered to be of reliable quality or easily testable. Instead words such as ââ¬Ëmany', ââ¬Ëoften' and ââ¬Ëmost' are used to precede a claim duping the reader into accepting the claim as truth. For example how many social workers see the nurses code as ââ¬Ëan enviable badge of professionalism'? On what has the author based the claim that most social workers have this view? Likewise, nowhere in the article is evidence or service user perspectives indicated to support the claim that the code represents ââ¬Ëa major gain' for them. Considering that the service user is central to social care and the current trend is towards increased service user consultation this is a glaring omission (Lloyd, 2002, p. 164). Compounding the tone of vagueness are unexplained terms and concepts, used within the article, which without resort to further information, leads to a difficulty in deciding whether the premises are sound (Browne & Keeley, 2001, pp. 41-58). For example ââ¬â How will the special health hearings work? What sorts of health issues are included? Because this is not determined, it seems alarmist and raises questions of possible discrimination in the workplace. This is particularly damaging in that anti-discriminatory practice is a core value of social work, which should constantly underpin practice. The issue of accountability is also ambiguous and concerning ââ¬â what is meant by the term ââ¬Ëindividually accountable'? Davies (ed. , 2000) states that ââ¬Å"Accountabilityâ⬠¦ at firstâ⬠¦ a simple concept, is in reality complex when applied to the practice of social work. There are a least four answers to the question: ââ¬Ëto whom is the social worker accountable for her or his actions? ââ¬Ëâ⬠. Accountability also holds connotations of blame (Banks, 2002, p. 30) which further demonstrates the importance of clear and unequivocal language (Adams et al. , eds. 2002). Having examined Damer's (1995) first three criteria the ââ¬Ërebuttal criterion' will now be attended to. In order for this to be fulfilled the author should acknowledge any counter arguments and respond to them in a reasonable and straightforward way. Let us come back to the analogy with the nurse's code. On the surface it appears to be a reasonable counter-argument, pointing out that the nurse's code has not fulfilled expectations although it is ââ¬Ëa useful guide'. In my opinion, however, it is a thinly veiled attempt to discredit the nurse's code as inferior to the new social work code ââ¬â partly on the basis that the nurse's code does not include employers (paragraph ten) although the previous paragraph seems to contradict this point. In paragraph eleven the author raises questions which allude to possible negative effects of the code but these are skimmed over and the information that follows seems purposefully vague. This assignment set out to examine the article using critical thinking skills and this has been achieved through the use of questioning and paying attention to problems in the reasoning, arguments and claims made. Unfortunately it has not been possible to raise everything discussed in the article. However, it has considered the strength of the article based on Damer's (1995) four criteria and been found lacking. Therefore, without clarifications and resort to further information, I can only conclude that the argument is flawed and, at this point, reject it as incomplete.
